1. Agreement to Terms

This Terms of Service ("Agreement") governs your access to and use of HearLink ("HearLink," "the Platform," "we," "our," or "us"), a self-help web-based tinnitus management and wellness platform. By accessing or using HearLink, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue use of the Platform.

2. Nature of the Platform

HearLink provides educational materials, sound therapy guidance, behavioral and cognitive strategies, and wellness-tracking tools designed to support individuals with tinnitus. The Platform is intended solely for educational and general wellness purposes and is not designed to diagnose, treat, cure, or prevent any medical condition.

HearLink is not a medical device and has not been reviewed or approved by the U.S. Food and Drug Administration (FDA). All content provided through HearLink is for self-help and informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified physician or audiologist for any medical concerns, particularly if you experience sudden hearing loss, ear pain, or worsening symptoms.

3. Eligibility

Use of HearLink is limited to individuals eighteen (18) years of age or older who have the legal capacity to enter into binding agreements. By using the Platform, you represent that you meet these requirements and will use the Platform only in accordance with applicable law.

4. User Accounts

Certain Platform features may require you to create an account. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your credentials. You are responsible for all activity conducted under your account. We reserve the right to suspend or terminate accounts suspected of unauthorized access or misuse.

5. Intellectual Property

All content, including software, text, graphics, sound, video, and design elements, is owned by or licensed to HearLink and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to use the Platform solely for personal, non-commercial purposes. No license or right is granted beyond this scope.

6. Third-Party Content and External Links

The Platform may include links to external websites, videos, or resources that are provided for informational and educational purposes only. These third-party materials are not owned, controlled, or maintained by HearLink. Their inclusion does not constitute an endorsement or warranty of their accuracy, completeness, or suitability.

7. Privacy

Use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and safeguard your personal information. By using HearLink, you consent to the processing of your information as described in that Policy.

8. Disclaimers

The Platform and its content are provided "as is" and "as available." HearLink disclaims all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or noninfringement. We make no guarantee that the Platform will be error-free, uninterrupted, or meet your expectations.

HearLink is not a healthcare provider and does not replace medical consultation. Always seek advice from a qualified healthcare professional before making decisions about your health or tinnitus management.

9. Limitation of Liability

To the fullest extent permitted by law, HearLink, its affiliates, officers, employees, and licensors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Platform. In no event shall our total liability exceed the amount you paid, if any, for access to the Platform during the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless HearLink, its officers, employees, and affiliates from any claims, damages, or expenses arising out of your misuse of the Platform, violation of these Terms, or infringement of third-party rights.

11. Modifications

We may update or modify these Terms or any part of the Platform at our discretion. Updated versions will be posted on our website with the revised effective date. Continued use constitutes acceptance of such modifications.

12. Termination

We reserve the right to suspend or terminate your access to the Platform without notice if you violate these Terms or engage in conduct deemed harmful to HearLink or other users.

13. Governing Law

This Agreement shall be governed by and construed under the laws of the State of Arizona, without regard to conflicts of law principles. Any disputes shall be resolved exclusively in the courts of Maricopa County, Arizona.

15. Entire Agreement

This Agreement, together with the Privacy Policy and any incorporated documents, constitutes the entire understanding between you and HearLink regarding the Platform and supersedes all prior agreements.
