1. Agreement to Terms

This Terms of Service ("Agreement") governs your access to and use of the Auralis platform and related services ("Auralis," "the Platform"), which is owned and operated by HearLink LLC ("Company," "we," "our," or "us"). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue use of the Platform immediately.

2. Nature of the Platform & Medical Disclaimer

2.1. Educational and Wellness Purpose Only

Auralis provides educational materials, sound therapy guidance, behavioral strategies (based on Cognitive Behavioral Therapy principles), and wellness-tracking tools designed to support individuals with tinnitus. The Platform is intended solely for educational, self-help, and general wellness purposes. It is not designed to diagnose, treat, cure, or prevent any medical condition or disease.

2.2. Not a Medical Device

Auralis is a digital therapeutic tool for habituation and wellness; it is not a medical device and has not been reviewed or approved by the U.S. Food and Drug Administration (FDA).

2.3. No Professional Medical Advice

All content provided through Auralis is for informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment.

• Assessment Tools: The Platform may utilize clinical surveys such as the Tinnitus Handicap Inventory (THI) or Tinnitus Functional Index (TFI). These tools are provided solely for personal tracking and self-monitoring. Any scores or feedback generated by these tools do not constitute a clinical diagnosis.
• Consult a Doctor: You should always consult a qualified physician or audiologist for any medical concerns, particularly if you experience sudden hearing loss, ear pain, physical trauma to the ear, or significantly worsening symptoms.

3. Eligibility

Use of Auralis is limited to individuals eighteen (18) years of age or older who have the legal capacity to enter into binding agreements. By using the Platform, you represent that you meet these requirements and will use the Platform only in accordance with applicable law.

4. User Accounts

Certain Platform features, including the "8-Week Core Program," require you to create an account. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your login credentials. You are solely responsible for all activity conducted under your account. We reserve the right to suspend or terminate accounts suspected of unauthorized access, sharing of credentials, or misuse.

5. Payment, Refunds, and Access

5.1. Fees and Payments

Certain features of the Platform, including the "Auralis Core Program" is offered for a fee. By selecting a paid service, you agree to pay the specified fees at the time of purchase. You authorize HearLink LLC to charge your chosen payment method for these fees.

5.2. Refund Policy

All Sales Final. Because Auralis provides immediate access to proprietary digital content and therapeutic protocols, all fees are non-refundable.

5.3. Lifetime Access

If you purchase a package labeled "Lifetime Access," this grants you access to the purchased version of the Auralis Core Program for the lifetime of the product's availability. HearLink LLC reserves the right to discontinue the Platform with reasonable notice (minimum 30 days), at which point "Lifetime Access" shall terminate without refund.

5.4. Mobile App Access

Purchase of the web-based Program does not automatically guarantee access to future mobile applications unless explicitly stated in a promotional offer at the time of purchase.

5.5. No Guarantee of Results

You acknowledge that tinnitus habituation is a highly individual process. HearLink LLC makes no guarantee that the Program will silence your tinnitus, cure your condition, or achieve a specific reduction in distress.

6. Intellectual Property

All content, including software, text, graphics, soundscapes, audio tracks, video, and curriculum design, is owned by or licensed to HearLink LLC and is protected by applicable intellectual property laws.

6.1. Limited License

You are granted a limited, non-exclusive, non-transferable right to use the Platform solely for your personal, non-commercial use.

6.2. Restrictions

You may not:

• Share your login credentials with others to allow multiple users to access a single paid account.
• Distribute, resell, reproduce, or publicly display any of the educational materials or audio tracks found within Auralis.
• Attempt to reverse-engineer or copy the Platform's features or content.

7. Third-Party Content and External Links

The Platform may include links to external websites, videos, or resources provided for informational purposes only. These third-party materials are not owned, controlled, or maintained by HearLink LLC. Their inclusion does not constitute an endorsement or warranty of their accuracy, completeness, or suitability.

8. Privacy

Use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and safeguard your personal information. By using Auralis, you consent to the processing of your information as described in that Policy.

9. Disclaimers of Warranties

The Platform and its content are provided "as is" and "as available." HearLink LLC disclaims all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We make no guarantee that the Platform will be error-free, uninterrupted, or meet your specific requirements.

10. Limitation of Liability

To the fullest extent permitted by law, HearLink LLC, its affiliates, officers, employees, and licensors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Platform. In no event shall our total liability exceed the amount you paid, if any, for access to the Platform during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless HearLink LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your misuse of the Platform, violation of these Terms, or infringement of third-party rights.

12. Modifications

We may update or modify these Terms or any part of the Platform at our discretion. Updated versions will be posted on our website with the revised effective date. Continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Platform without notice if you violate these Terms or engage in conduct deemed harmful to HearLink LLC or other users.

14. Governing Law

This Agreement shall be governed by and construed under the laws of the State of Arizona, without regard to conflicts of law principles. Any disputes shall be resolved exclusively in the courts of Maricopa County, Arizona.

16. Entire Agreement

This Agreement, together with the Privacy Policy and any incorporated documents, constitutes the entire understanding between you and HearLink LLC regarding the Platform and supersedes all prior agreements.
